Terms

Engara terms of service

These terms govern access to Engara's website and, unless a signed agreement states otherwise, the Engara AI engagement platform.

Effective July 29, 2026

Who is entering into these terms?

“Engara”, “we” and “us” mean EduSight Technologies Inc., a company incorporated in Vancouver, British Columbia, Canada, with its registered office at Unit 2900, 550 Burrard Street, Vancouver, British Columbia V6C 0A3, Canada. “Customer” means the organisation accepting these terms or signing an order for the service.

A person accepting on behalf of a customer confirms that they have authority to bind that organisation. A signed order, master agreement or other negotiated contract takes precedence if it conflicts with these online terms.

What service does Engara provide?

Engara provides AI-assisted engagement, qualification, journey orchestration, multichannel messaging, analytics and Generative Engine Optimization capabilities described in the applicable order or documentation. Features, usage limits, integrations, implementation responsibilities and support commitments are defined in the commercial agreement.

What is the customer responsible for?

The customer is responsible for its authorised users, account credentials, channel accounts, customer content, required notices and consents, and the legality of its configured journeys. The customer must have the rights needed for content and data it gives Engara and must keep account access reasonably secure.

AI output can be incomplete or incorrect. The customer must review output in light of the source, use case and potential impact, and maintain human oversight for admissions, legal, medical, financial or other consequential decisions.

What uses are not permitted?

  • Unlawful, deceptive, discriminatory, abusive or fraudulent activity.
  • Attempts to bypass access, usage, safety or security controls.
  • Malware, credential theft or unauthorised system access.
  • Unsolicited messaging that violates channel rules or applicable law.
  • Collection of information that the approved journey does not need.
  • Reverse engineering except where the law does not permit restriction.

Who owns content and service materials?

The customer retains its rights in customer content and data. It grants Engara the limited rights needed to host, process, transmit and display that content to provide, support and secure the contracted service. Engara retains its rights in the platform, documentation, methods and service materials, excluding customer content.

Feedback may be used to improve Engara without identifying the customer or disclosing its confidential information. Any public use of a customer's name, logo or story requires the permission provided in the applicable agreement or a separate approval.

How are privacy and security handled?

The privacy policy explains our website practices. Customer service data is governed by the applicable agreement and any data-processing terms. Current high-level security and procurement information is available in the trust centre. Customers must configure their deployments to collect only information needed for an approved purpose.

How do fees, renewals and taxes work?

Contact Engara for pricing. Fees, usage charges, payment dates, renewal terms and applicable taxes are set out in the customer's order form or other signed commercial agreement. Engara is not required to begin paid implementation work until the applicable order is accepted.

When may access be suspended or terminated?

We may suspend access when reasonably necessary to address a security risk, unlawful use, material breach or overdue payment, subject to the notice and cure terms in the applicable agreement. On termination, export, retention and deletion follow the customer's contract and data-processing terms.

Are third-party services part of Engara?

Engara may connect with third-party channels, models, websites or business systems. Those services are governed by their own terms and policies, and Engara is not responsible for a third party's independent service. The customer is responsible for maintaining any external accounts required for its chosen integration.

Which warranties and liability terms apply?

To the maximum extent permitted by law, the website and any evaluation access are provided on an “as available” basis. Paid service commitments, remedies, indemnities and liability limits are those stated in the applicable signed agreement. Nothing in these terms excludes a right or liability that cannot lawfully be excluded.

Which law governs these terms?

These terms are governed by the laws applicable in British Columbia, Canada, without limiting any mandatory right that applies in another jurisdiction. The parties should first try to resolve a dispute through good-faith discussion before starting formal proceedings.

How can Engara be contacted about these terms?

Send questions or legal notices to support@engara.ai and EduSight Technologies Inc., Unit 2900, 550 Burrard Street, Vancouver, British Columbia V6C 0A3, Canada.

We may update these terms as the service or applicable law changes. The current version and effective date will be published on this page, with additional notice where a contract or law requires it.
